Most employers are aware Iowa law permits private employers to conduct drug testing of employment applicants and employees. What many employers do not know, however, is that the law includes a slew of procedural requirements and restrictions on who can be tested, when they can be tested, and under what circumstances the employer can require a test. Even more troubling, if an aggrieved person proves an employer violated the complicated drug testing law, the employer may be on the hook for the other person’s attorney’s fees.
