OSHA's Multi-Employer Citation Policy
OSHA is using its authority under this Policy to write more citations per inspection to more employers on site. This Policy gives directions to Inspectors on how to identify not only the employer whose workers are exposed to a hazard covered by the Regs but also to employers who created, have control over or are responsible to correct the citable situation. For instance the excavation contractor could be cited for digging a 10’trench with vertical walls even though it has no employees in the trench. The GC will also be cited because it did not “control” the site and failed to recognize this as a hazard. Finally, the employer whose workers are in the trench will be cited.
