This webinar will describe the rights and obligations of private employers under Iowa law with regard to workplace drug or alcohol testing. The information is designed to confirm important compliance issues for employers who already conduct testing and provide information for employers considering implementing a drug/alcohol testing program. Specific cases will be discussed where failure to comply resulted in employer liability. Along with the statutory compliance guidance, this webinar also advises employers how to handle potential impairment issues in the workplace without resorting to testing for substances. These tools include performance management, behavior management and fitness for duty testing. We will discuss how these tools can be used in lieu of, or in addition to, testing (for example, when a drug test comes back negative).
